from many points of view, and the period fits in with the

amount of full pay leave I am entitled to apply for. It is also,

as I informed Your Excellency in my application convenient for

Court work, as there are cases in which judgments will have to

be given which are not yet ready, and which will in accordance

with custom be delivered in term time.

I note that Your Excellency proposes to

defer any action with regard to the £50 mentioned in the Secre-

-cary of State's cable, pending the return of Mr. Ellifax. In

Your Excellency's letter of 12th. September you say that so far

as you can see this charge would fall upon me unless the

Secretary of State consents to regard the circumstances of r

roing on leave as hing of a very special nature. I cannot adult

that in any circumstances this, or any other charge corrected

with Mr. Hallifax's recall can fall on me. Hr. Hallifax's

going on leave is a matter with which I an unconcerned, though

of course I regret the unfortunate cause.

The facts are very simple. Some 9 months

ago an agreement was come to havweer Your Excellency and ny-

-self on the subject of my leave, and also of Mr. Rees Davies'

leave. It was arcanred that they should be fitted in, and this

agreement has formed the basis of correspondence up to the last

minute. The fact that some time ago Mr. Hallifax was granted a

period of leave, which, through an oversight apparently, was not

so arranged as to fit in with the agreement as to my leave, 18

no fault of mine. The payment, if any, which may have to be

made falls naturally in the circumstances on the Government.
